WASHINGTON, D.C. (May 25, 2023) 鈥� 网曝吃瓜 applauds today鈥檚 decision by the U.S. Supreme Court in the case Sackett v. Environmental Protection Agency. The Court determined the EPA and the Department of the Army had overstepped the federal authorities granted under the Clean Water Act. 网曝吃瓜 filed an amicus brief in the case arguing against the Ninth Circuit鈥檚 ruling.

鈥淭oday鈥檚 decision in Sackett v. EPA provides long-needed clarity for small business owners and landowners,鈥� said Beth Milito, Executive Director of 网曝吃瓜鈥檚 Small Business Legal Center. 鈥淭he ever-changing standard and definition of 鈥榳aters of the United States鈥� has disproportionately impacted small businesses, including farmers, ranchers, home builders, and contractors. The Supreme Court鈥檚 ruling today affirmed the limits set by Congress and will rein in the extreme interpretation of the Clean Water Act.鈥�

The case questioned whether the U.S. Court of Appeals for the Ninth Circuit set forth the proper test for determining whether wetlands are 鈥渨aters of the United States鈥� under the Clean Water Act. When a wetland is deemed to be a 鈥渨ater of the United States,鈥� and thus subject to EPA鈥檚 jurisdiction, landowners can expect both bureaucratic and financial obstacles to improving their lands. Today鈥檚 decision narrows the number of situations in which the EPA will have jurisdiction.

In December, 网曝吃瓜 opposed the Environmental Protection Agency鈥檚 (EPA) and the Department of the Army鈥檚 final rule on the waters of the United States.
